Terms of Service

1. Acceptance of Terms
By accessing or using bitli.st ("the Service", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
bitli.st is operated under French law. By using the Service, you acknowledge that any dispute will be governed by French law and subject to the jurisdiction of French courts.
2. Description of the Service
bitli.st provides a platform that allows builders and entrepreneurs ("Clients") to deploy customizable waitlist landing pages. These pages can collect:
- Email addresses from end users ("Visitors") who wish to join a waitlist.
- Payments from Visitors via Stripe Connect, for pre-orders or founding member spots.
bitli.st acts as a platform provider — it does not sell products or services directly to Visitors on behalf of its Clients.
3. Eligibility
You must be at least 18 years old and legally capable of entering into contracts under applicable law to use the Service. By using bitli.st, you represent that you meet these requirements.
4. Client Accounts
When you create an account, you agree to:
- Provide accurate, current, and complete registration information.
- Keep your credentials secure and confidential.
- Notify us immediately of any unauthorized use of your account.
You are solely responsible for all activity that occurs under your account.
5. Acceptable Use
You agree not to use bitli.st to:
- Collect data from individuals without their explicit consent.
- Run fraudulent, deceptive, or misleading campaigns.
- Violate any applicable law or regulation, including GDPR and consumer protection laws.
- Distribute spam or engage in any abusive email practices.
- Collect payments for illegal goods or services.
- Impersonate any person, company, or brand.
We reserve the right to suspend or terminate accounts that violate these rules, without prior notice.
6. Access to Lead Data
When Visitors submit their email or payment on a Client's waitlist page, that data is stored securely by bitli.st on behalf of the Client. Clients may:
- View their collected leads directly from their dashboard.
- Export their lead data at any time as a CSV or JSON file.
Clients may not modify or manually delete individual lead records through the platform. If a data deletion is required (e.g. following a Visitor's request under applicable privacy law), the Client must contact bitli.st as described in Section 7 below.
bitli.st does not use, share, or process Client lead data for any purpose other than providing the Service.
7. Data Deletion Requests (Visitor Rights)
If a Visitor requests deletion of their personal data:
- The Visitor should contact the Client who owns the waitlist page, or contact bitli.st directly at lrzalexandre@gmail.com with the subject line "Data Deletion Request" and the email address to be deleted.
- bitli.st will process the deletion request within 30 days of receiving it.
- Clients are responsible for forwarding any deletion requests they receive from their Visitors to bitli.st promptly.
8. Payments & Stripe Connect
Payments collected through Client waitlist pages are processed via Stripe Connect. By enabling payment collection on your page:
- You agree to Stripe's Terms of Service and Connected Account Agreement.
- You acknowledge that you are the merchant of record for any transaction initiated on your waitlist page — not bitli.st.
- You are solely responsible for fulfilling obligations to your customers (delivery, refunds, customer support, etc.).
- bitli.st is not liable for any payment disputes, chargebacks, or fraudulent transactions initiated through your page.
bitli.st may receive a platform fee through Stripe Connect for facilitating payment infrastructure.
9. Client Responsibilities
By deploying a waitlist page on bitli.st, you acknowledge that:
- You are solely responsible for ensuring your use of the Service complies with the laws and regulations applicable in your jurisdiction and those of your Visitors, including but not limited to GDPR, CCPA, LGPD, and PIPEDA.
- Clients are encouraged to provide their Visitors with appropriate privacy disclosures and, where applicable, terms governing any payment collected.
- Clients are encouraged to obtain any consents required by applicable law before collecting personal data or processing payments from Visitors.
- Any Visitor data requests (access, deletion, rectification) received by a Client should be promptly forwarded to bitli.st at lrzalexandre@gmail.com
bitli.st is not liable for any failure by a Client to meet their legal obligations toward their Visitors.
10. Intellectual Property
All content, trademarks, and code powering the bitli.st platform are the property of bitli.st or its licensors. You may not copy, reproduce, or reverse-engineer any part of the Service.
Your custom content (titles, descriptions, branding) on your waitlist page remains your property.
11. Pricing & Payments to bitli.st
bitli.st offers one-time payment plans. Prices are clearly displayed at checkout. By purchasing a plan:
- You acknowledge the plan duration (30-day or lifetime) and included features.
- No refunds are offered after account activation, except where required by applicable French consumer law.
- You agree that access to the Service during the active plan period constitutes full delivery of the digital service.
12. Service Availability
We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance, apply updates, or experience outages without prior notice. bitli.st is not liable for any losses arising from service unavailability.
13. Limitation of Liability
To the fullest extent permitted by French law:
- bitli.st is not liable for indirect, incidental, or consequential damages.
- Our total liability to you shall not exceed the amount you paid to bitli.st in the 12 months preceding the claim.
- We are not liable for data loss resulting from misuse, third-party failures (Cloudflare, Supabase, Stripe), or circumstances beyond our control.
14. Termination
We may suspend or terminate your access at any time if you violate these Terms. You may cancel your account at any time by contacting us. Termination does not entitle you to a refund for any unused plan period.
Upon termination, your lead data remains stored for 30 days before permanent deletion, unless you request earlier deletion.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service. Continued use after the effective date constitutes acceptance of the updated Terms.
